The anti-dumping bureau of the Indian Ministry of Commerce and Industry issued the final ruling on anti-dumping investigations on tetrafluoroethane (1, 1, 1, 2-Tetrafluoroethane or R-134a) originating in China and Japan on May 10, recommending the imposition of formal anti-dumping measures on imported products. Taxes (the tax period is 5 years until April 18, 2015).
In the final announcement, the anti-dumping bureau still regards China as a non-market economy country and uses structural prices to calculate the normal value of Chinese products. The dumping margins of the three Chinese export companies were determined to be 30-50%, and those of other Chinese enterprises were 45-55%.
According to its dumping margin, the Anti-dumping Bureau has comprehensively considered the import quantity, market share, import price, production capacity, sales volume and cost, profit margin, inventory, and other factors, and has determined that Chinese products have caused substantial damage to domestic industries. Based on this, the Bureau proposes to impose formal anti-dumping duties on Chinese products.
In the end, the dumping rates of the three Chinese export companies were identified as US$1.15-1.36/ton, and other Chinese companies were US$1.41/ton.
The final ruling stated that all stakeholders may appeal to the Customs and Revenue Appeals Tribunal for this final award.
